York County prosecutors are appealing the 5-to-10 year prison sentence of the York man who pleaded guilty to manslaughter in the drunk driving death a year ago of Bayard native and Aurora High School volleyball coach Lauren Akerson.
Otis Newcomb had faced up to 20 years in prison, but received the shorter term in August by Judge James Stecker.
NTV Television says the York County Attorney’s Office has challenged the sentence to the Nebraska Court of Appeals, calling it “excessively lenient.”
The 31-year-old Akerson, a 2000 graduate of Bayard High School and an Aurora grade school teacher, was a passenger in a vehicle that was hit by Newcomb, who had crossed the center line of Highway 34 near York.
Newcomb had a blood alcohol level of .113, well over the legal limit.
